The non-consensual dissemination of intimate images (NCDII) is a policy and regulatory matter that requires collaboration between the government, private sector and civil society.

Session description

Non-consensual dissemination of intimate images (NCDII) is a growing cybercrime phenomenon that requires, among others, criminal justice action. For example, Article 16 of the United Nations Convention on Cybercrime defines this as “[…] when committed intentionally and without right, the selling, distributing, transmitting, publishing or otherwise making available of an intimate image of a person by means of an information and communications technology system, without the consent of the person depicted in the image.”

The scope of criminalisation; freedom of expression; protection of privacy, dignity, and freedom from violence; right of victims; responsibilities of service providers and intermediaries- this is a non-exhaustive list of issues that comes into play.

Elif Sariaydin, from the Group of Experts on Action against Violence against Women and Domestic Violence (GREVIO) of the Council of Europe, will introduce the concept of NCDII, based on data from reports evaluating legislative and other measures taken by the parties to give effect to the provisions of the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence (Istanbul Convention).

Giorgi Jokhadze, from the Cybercrime Programme Office of the Council of Europe will present cybercrime and e-evidence standards under the Convention on Cybercrime (Budapest Convention) and its Second Additional Protocol, necessary for the investigation and prosecution of NCDII offences, with references to substantive law and cooperation with service providers. These contributions will be followed by a Q&A session with members of the audience.
