The workshop will discuss the tension between the cross-border nature of the Internet and national laws in Europe and beyond. The speakers will explore together with the audience the rising number of direct requests from one country to Internet companies in other jurisdictions and the evolution of intermediary liability regimes and Terms of Service in this context.

Session description

Although the Internet is a global resource, economic and regulatory factors have concentrated many large intermediary services in one jurisdiction, the United States. This has led to an environment in which even intermediaries based in other jurisdictions tend to standardise around terms of service compatible with United States law, such as a notice and takedown system for handling copyright complaints. Yet these terms of service are not equally compatible with other countries' laws, nor are they necessarily representative of the interests of users in those countries. This raises a question: is there a public interest in constraining the terms of service that intermediaries may voluntarily adopt, to bring these into accord with a more global set of human rights-based norms? Should intermediaries be obliged to resist informal external pressures to enforce terms of service that, if applied directly by states, would be an infringement of users' rights of freedom of expression or association?
