The debate on the relationship between encryption and access to electronic evidence has been picked up again in Europe. In general, lawmakers, civil society and tech industry agree that the use of encryption is a necessary means of protecting fundamental rights and the digital security of citizens, governments, industry and society. In December 2020, the Council of EU adopted a resolution on "security through encryption and security despite encryption", calling for an EU regulatory framework and technical solutions for gaining access to encrypted data by competent authorities. However, providing law enforcement with a possibility to break or circumvent encryption will always weaken the encryption. Should encryption that does not offer access to law enforcement be banned or is the use of encryption an economic necessity and a fundamental right?
